Terms of Service
Effective date: July 9, 2026 · HotSpot Estates, LLC
This agreement is between HotSpot Estates, LLC ("Service Provider"), owner and operator of the AgentResponder software, and the individual or business using the service ("Client"). By signing up and using the service, you agree to the terms outlined below.
1. The Service
The Service Provider grants the Client access to the AgentResponder software, which automatically processes real estate inquiry emails from Zillow and StreetEasy, sends email and text replies to leads, and creates contacts in Quo (OpenPhone). The service runs through the Client's own Google account and Quo account.
2. Billing & Payment
All payments are processed securely through Stripe. Available plans:
- • Starter — Up to 4 listings — $49.95/mo
- • Pro — Up to 10 listings — $114.95/mo
- • Unlimited — Unlimited listings — $149.95/mo
Payment is due on the same date each month via Stripe. The Service Provider reserves the right to suspend access if payment is more than 3 calendar days late. Fees are non-refundable once the billing period has started. A 7-day free trial is available to new clients. A valid payment method is required at sign-up and will be charged automatically at the end of the trial period.
3. Term & Cancellation
This agreement begins on the date of sign-up and continues month-to-month. Either party may cancel at any time. Access remains active through the end of the current paid billing cycle. No additional charges will be made after cancellation. Clients may cancel at any time from their dashboard.
4. Client Responsibilities
The Client agrees to:
- • Provide accurate account credentials (Quo API key, Gmail address) during setup.
- • Keep their Google account and Quo account active and in good standing.
- • Maintain their own listing templates within the dashboard.
- • Not share their account access with anyone else.
- • Comply with all applicable laws when sending automated messages to leads, including but not limited to the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.
5. Limitations of Liability
The Service Provider is not responsible for missed inquiries, delivery failures, or issues caused by third-party platforms (Gmail, Zillow, StreetEasy, Quo/OpenPhone). The service is provided as-is. The Client's total remedy for any claim is limited to a refund of the most recent monthly payment.
6. Hold Harmless & Indemnification
The Client agrees to hold harmless, defend, and indemnify HotSpot Estates, LLC, its owners, and affiliates from and against any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) any automated messages sent on the Client's behalf through the AgentResponder system; (b) the content of the Client's email or text templates; (c) any violation of applicable federal, state, or local laws governing electronic communications; or (d) any complaint, dispute, or legal action initiated by a lead or third party as a result of messages sent through the service. HotSpot Estates, LLC is not responsible for the content of messages sent, the accuracy of lead information, or the outcome of any communication initiated by the system.
7. Confidentiality
The Client agrees not to reverse-engineer, copy, resell, or share the software or its underlying code. The Service Provider agrees not to share the Client's personal information or lead data with any third party, except as required by law or as necessary to operate the service (e.g., payment processing via Stripe).
8. Data & Service Improvement
By using the service, the Client agrees that HotSpot Estates, LLC may use anonymized, aggregated data derived from platform usage — including listing templates, response patterns, and general usage behavior — to improve, develop, and train internal tools and AI systems that enhance the service. This data will never be shared with third parties and will not include personally identifiable information of leads or clients. Individual client data will never be attributed or identifiable in any resulting model or tool. If you do not agree to this use, you may opt out at any time by contacting us at inquiryautoresponse@gmail.com — your access to the service will not be affected.
9. Changes to Terms
The Service Provider may update these terms with 14 days' notice by email. Continued use of the service after that period constitutes acceptance of the new terms.
